Testament Write explained using the example

Only hand written testaments are effective.

Leave no will, the law regulates voluntarily the legal succession. Would a particular person who is not or only partially as legal heir (heirs 1st order are your spouse and your children) is provided, determine your (sole) heir, you need to write a will.

Only a handwritten will is valid

  1. It is crucial that you write the text completely with your hand. Do not use a computer and a typewriter. You may also anyone else dictate the text. Only your personally authored Testament is valid. This is even more than perhaps its effectiveness should be questioned later.
  2. Surtitles the text with "testament" or "my last will".
  3. Formulate without terms and conditions and set the desired person without ifs and buts as the heirs.
  4. Sign the Testament with your first and last name and set the place and date it.
  5. Ideally, you have the text of an impartial third party who has no right and no interest in your heritage, confirm as witnesses.

You can also write a legacy

  • Alternatively, is also a legacy into consideration. Do you want a particular person to get a certain object of value or amount of money, you do not need the legal succession to change.
  • It is sufficient if you dub the text as a legacy and thus oblige the heir to act on your behalf.
  • You can enter formulate the legacy in the will. Just write what you want and name of the person legatee.

Example of how you could make the text

  • Example: "Testament". "I, Hans Müller, hereby put my nephew, Werner Hypocritical, born on 05.16.1987 in Duckburg to my sole heir. Frankfurt, 22.6.2012, Signature Hans Müller".
  • Example, if you want to determine your spouse's sole heir: "..., put herewith my spouse ... my sole heir My children should receive only the mandatory parts ....."
  • You should know that you can not complete its withdrawal from the Heritage your legal heirs. This always retain their reserved portion. He is one half of the statutory portion and is generally paid by the testamentary heirs certain in money.
  • Konsulieren If in doubt, a notary or lawyer. Depending on your situation, the design of a will can be very demanding and complex. In addition, you can store it eV by the notary at the German register of wills.
